1. Who we are, and what you're agreeing to
MadeApt ("we," "our," or "us") is a made-to-measure clothing platform based in Boorloo (Perth), Western Australia. We help you design a garment — from a description, a picture, a community design, or a conversation — and have it made to your measurements by a vetted maker in our network.
By using madeapt.com, creating an account, or placing an order, you agree to these terms, our Privacy Policy, and our Returns, Remakes & Refunds Policy. If you don't agree, please don't use the service.
Nothing in these terms limits your rights under the Australian Consumer Law (ACL) or any other law that cannot be excluded.
2. Accounts
- You must be at least 16 to create an account, and at least 18 (or have a parent or guardian's consent) to place an order.
- We sign you in with a magic link sent to your email — keep access to that inbox secure, because anyone with it can access your account.
- Give us accurate information, especially your email and shipping address. We're not responsible for orders sent to an address you gave us incorrectly.
- You're responsible for activity on your account. Tell us straight away if you think someone else is using it.
3. The design studio and AI tools
- Our design tools (the studio, the design consultant chat, virtual try-on, fabric visualisation) can use AI to help you explore ideas. AI is always optional — every creation flow also works without it.
- AI-generated previews are design direction, not photographs of your finished garment. Details are resolved with you before anything is made, and some generated details may need reinterpreting to be physically sewable. What you approve in the design brief — not the preview image — defines the commission.
- Virtual try-on images are visual estimates, not guarantees of fit. Fit comes from your measurements.
- Generation features have fair-use limits (credits). Credits and any complimentary top-ups have no cash value.
4. Commissions, prices and payment
- Every garment is made to order. Your order becomes a commission when payment is made, and moves through our quality gates (G0–G5) with your sign-off at the key stages — see the returns policy for how the gates work.
- Prices are in Australian dollars unless a page states otherwise (some private commission pages are quoted in USD). The price and currency shown at checkout are what you pay.
- Payments are processed by Stripe. Where offered, Afterpay, Klarna and instalment plans are subject to those providers' own terms. For instalment plans we describe on a commission page, the schedule shown at checkout is the schedule you're agreeing to.
- Quotes and private commission pages are prepared for a named client and a specific brief; we may withdraw or revise a quote before you accept it.
- We may decline or refund an order before work begins — for example if a maker is unavailable or a design can't responsibly be made in the time available. If we do, you get a full refund.
5. Measurements
- Your garment is cut to the measurements we hold for your order. We send a measurement guide after checkout and offer guided ways to be measured.
- If you supply your own measurements, you're responsible for their accuracy. A garment that matches the measurements you gave us (within tolerance) has been made correctly — the returns policy explains what we do to help even then.
- If we or your maker take or verify your measurements, fit within tolerance is on us.
6. Making and delivery
- Garments are made individually by makers in our network across Australia, Vietnam and Bosnia. Timelines we show are estimates unless we commit to a date in writing.
- If your order has a hard deadline (a wedding, an event, a departure), tell us at the time of ordering — committed dates we've agreed to are covered by the returns policy.
- Delivery is to the address on your order, with tracking. Risk in the garment passes to you on delivery; ownership passes on payment in full.
- International orders may attract customs duties or taxes in your country, which are your responsibility unless the order page says otherwise.
7. Returns, remakes and refunds
Made-to-measure changes how returns work, but not your protections. What we cover (faults, departures from your approved design, fit when we measured you, transit damage, missed committed dates), what we don't (change of mind after cutting, self-measured fit within tolerance), and how to raise an issue are set out in the Returns, Remakes & Refunds Policy, which forms part of these terms.
8. Your content and your designs
- You keep ownership of what you upload — reference images, photos, fabric pictures, and the designs you create. You give us a licence to store, display and process that content to run the service: to render previews, prepare briefs and tech packs, and have your garment made.
- Only upload content you have the right to use. Reference images are used as design direction — we interpret the design language of a reference; we don't copy protected prints, logos, labels or branded artwork, and we don't pass garments off as another brand's.
- Sharing a design to the community is your choice and clearly marked when it happens. Shared designs can be seen, remixed and commissioned by others, with your design credited. You can unshare a design; pieces already made or remixed from it are unaffected.
- Don't upload content that is unlawful, infringing, or abusive. We may remove content and suspend accounts that break these rules.
9. First Nations fabrics and artist artwork
- Artwork in our First Nations fabric collection remains the artist's. It is licensed for use on garments, a royalty is paid to the artist on qualifying orders, and the artwork is applied by our digital team and makers — never generated or altered by AI.
- You may not extract, reproduce or reuse artist artwork outside the garment it was commissioned on.
10. Points, credits and rewards
- Studio points, credits and rewards are a loyalty program, not money. They have no cash value, can't be transferred or redeemed for cash, and may expire.
- We may change or end the program, or correct balances affected by error or abuse, with reasonable notice where the change matters to you.
11. Acceptable use
Don't:
- use the service for anything unlawful, or to harass or harm anyone;
- scrape, bulk-download, or programmatically extract content, designs or artwork;
- interfere with the service's operation or attempt to access accounts or data that aren't yours;
- use our tools to create counterfeits or content that infringes someone else's rights.
12. Our content
The MadeApt site, brand, tools, templates and editorial content are ours or our licensors'. You may use them within the service and for your own commission; you may not republish or commercialise them without permission. If you give us feedback, we can use it without obligation.
13. Third-party services
We rely on third parties to run the platform — payment processing (Stripe, Afterpay, Klarna), AI providers for the optional design tools, shipping carriers, and hosting. Their services are subject to their own terms, and outages or changes on their side are outside our control, though we'll always work to put things right for your order.
14. Liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any liability that cannot lawfully be limited.
To the extent permitted by law, our liability for anything else arising out of the service is limited, at our option, to resupplying the relevant goods or services or refunding what you paid for them, and we aren't liable for indirect or consequential loss. We're not liable for delay or failure caused by events outside our reasonable control.
15. For businesses and studios using MadeApt
Studios, labels and brands that run on MadeApt's platform have separate agreements with us, and purchases made through them are governed by their terms. These terms cover accounts and commissions placed directly with MadeApt.
16. Ending or changing things
- You can close your account at any time; orders already in progress are completed under these terms and the returns policy.
- We may suspend or close accounts that break these terms. If we do, in-progress orders are refunded or completed fairly, depending on the stage they've reached.
- We may update these terms. Changes are posted here with a new "Last updated" date; material changes to how orders work apply to orders placed after the change.
17. Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia, and disputes are subject to the courts there — without limiting your right to bring claims under consumer protection laws where you live.
